Movement of Services

 

After 1 May 2004, free movement of services between the EU Member States is ensured. There are two exemptions, namely Austria and Germany, which will be allowed to limit the provision of services with posted workers by Slovenian companies in certain sectors during the period in which their national legislation in the field of the free movement of workers will be applied.

 

 

Provision of services in Slovenia after 1 May 2004


Free provision of services means that a work permit is no longer required for a worker posted to Slovenia. Slovenian employers who contract services to be provided in Slovenia with a foreign partner from the EU must submit a notification of provision of services to the Employment Service of Slovenia for the purpose of registering workers posted to Slovenia.

Provision of services in EU Member States after 1 May 2004


Slovenian undertakings providing services in the EU Member States are not required to obtain work permits for their posted workers as no such precondition is applied by the Member States for accessing their labour markets. Likewise, the third country nationals employed by a Slovenian employer on the basis of a work permit to provide services in the EU Member States are not required to obtain work permit (except for certain sectors in Austria and Germany). Currently, most countries require workers posted to their country to be registered for the purpose of easier monitoring.
 
A foreign employer who wishes to provide services in the EU Member States must be acquainted in advance with the procedures which differ from country to country. Therefore, each Member State has a Liaison Office or reference points where undertakings can obtain all necessary information.
